The right of one person involves consequent duties to respect the rights of others. Its exercise must never be misused, especially to the prejudice of another. A right vanishes the moment it is abused. A person is sheltered only when he acts in the rightful exercise of his rights, i.e., he acts with justice, gives everyone his due, and observes honesty and good faith.
Throughout history, patients have relegated their fates and lives to the skill of their doctors. For a breach of this trust, men have been quick to claim justice. Some 4,000 years ago the Code of Hammurabi provided certain forms of punishment for physicians who failed to observe standard care in the exercise of their profession. At present, the primary goal of the medical profession is the protection of life and maintenance of the health of the people. Needless to say then, when a physician drifts from his revered duty and jeopardizes instead the life of his patient, he must be made to answer for any penalty to it or be made to answer compensation claim.
